1. Who we are

GetSetGrow Care Solutions Inc. ("GetSetGrow", "we", "us", "our") is a corporation registered in Canada. We operate the GetSetGrow clinical AI therapy platform, including the website at getsetgrow.com and getsetgrow.ca and the GetSetGrow mobile application ("the App").

2. The data we collect

2.1 Account and profile data

• Caregiver email address and password (hashed — we never store plain-text passwords)
• Child's first name and date of birth (used only to calculate developmental age ranges)
• Province or territory of residence (used to surface relevant funding programs)
• Clinician or therapist email address (optional, only if you choose to link a clinician)

2.2 Clinical session data

• Diagnosis categories selected during onboarding (e.g. ASD, ADHD)
• Communication level, sensory profile, and reinforcer preferences
• Session activity logs: trial responses, response latency, accuracy scores, prompt levels used
• Progress data: module mastery percentages, pyramid level, PECS phase
• Session timestamps and duration

This clinical data is treated as sensitive health information under PIPEDA and, where applicable, HIPAA. It is encrypted at rest (AES-256) and in transit (TLS 1.3).

2.3 Technical data

• Device type, operating system version, and app version
• IP address (used for fraud prevention and regional content — not stored long-term)
• Crash reports and error logs (anonymised before storage)

2.4 Data we do NOT collect

• We do not collect audio or video recordings without explicit per-session consent
• We do not collect location data beyond province/territory
• We do not use advertising tracking pixels or third-party ad networks
• We do not collect social media identifiers

3. How we use your data

• Delivering the service: personalising sessions, tracking progress, generating reports
• Clinical safety: detecting error patterns, triggering appropriate support responses
• Funding Navigator: matching your province to relevant government programs
• Clinician collaboration: sharing session data with linked therapists you have authorised
• Service improvement: aggregated, anonymised analytics to improve clinical algorithms
• Communications: launch notifications, session reports, and funding updates (you can opt out at any time)

We do not use your data for advertising, profiling for commercial purposes, or sale to third parties under any circumstances.

4. Children's privacy (COPPA & PIPEDA)

We comply with the Children's Online Privacy Protection Act (COPPA) and Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) with respect to children's data:

• Verifiable parental or guardian consent is obtained before any child profile is created
• Child profile data is stored separately and subject to enhanced access controls
• We do not serve advertising to children or use child data for commercial profiling
• Parents and caregivers may request complete deletion of a child's profile at any time
• Session video is never recorded without explicit per-session written consent

5. Sharing your data

We share data only in the following circumstances:

• Linked clinicians: session data is shared with therapists you have explicitly authorised in the app
• Service providers: cloud hosting (Canadian-based servers), email delivery, and analytics — all under data processing agreements that prohibit use of your data for any purpose other than providing services to us
• Legal requirements: if required by Canadian law, court order, or to protect safety
• Business transfer: in the event of a merger or acquisition, data would transfer subject to the same protections in this policy and advance notice to you

We do not sell personal data. We do not share data with advertisers.

6. Data storage and security

• All personal and clinical data is stored on servers located in Canada
• Encryption at rest: AES-256. Encryption in transit: TLS 1.3
• Access to personal data is restricted to employees who need it to provide the service
• We conduct regular security reviews and are on a path to SOC 2 Type II certification
• In the event of a data breach, we will notify affected users within 72 hours as required by PIPEDA

7. Your rights

Under PIPEDA, you have the right to:

• Access: request a copy of the personal data we hold about you
• Correction: request correction of inaccurate data
• Deletion: request deletion of your account and all associated data
• Withdrawal of consent: withdraw consent for data processing at any time (this will result in inability to use the service)
• Portability: receive your clinical session data in a machine-readable format (CSV)

To exercise any of these rights, email privacy@getsetgrow.ca. We will respond within 30 days.

8. Cookies and tracking

The GetSetGrow website uses only essential cookies required for the site to function (session management). We do not use advertising cookies, tracking pixels, or third-party analytics that share data with external parties.

The mobile app does not use cookies. It uses secure local storage for session state only.

9. Retention

• Account data is retained for as long as your account is active
• Clinical session data is retained for 7 years after the last session (to support long-term clinical tracking) unless you request earlier deletion
• Anonymised aggregate analytics data may be retained indefinitely
• Upon account deletion, all personally identifiable data is purged within 30 days

10. Third-party links

The Funding Navigator section of GetSetGrow links to government websites (provincial autism funding programs). We are not responsible for the privacy practices of those external sites.

11. Changes to this policy

We may update this Privacy Policy from time to time. When we make material changes, we will notify you by email and post a notice in the app at least 14 days before changes take effect. Continued use of the service after that date constitutes acceptance of the updated policy.

1. Acceptance of terms

By accessing or using the GetSetGrow platform (including getsetgrow.com, getsetgrow.ca, and the GetSetGrow mobile application), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the service.

These Terms form a legally binding agreement between you and GetSetGrow Care Solutions Inc. ("GetSetGrow", "we", "us"). If you are using GetSetGrow on behalf of an organisation (such as a therapy clinic or school), you represent that you have authority to bind that organisation to these Terms.

2. Eligibility

• You must be at least 18 years old to create an account
• Children may use the app only under direct supervision of an adult account holder
• Clinic accounts must be operated by or under the supervision of a qualified healthcare professional
• You must provide accurate information when creating your account

3. The service

GetSetGrow provides a clinical AI-assisted therapy support platform including:

• Structured therapy activity modules for children with neurodevelopmental differences
• The GetSetGrow AI™ engine for session personalisation and progress tracking
• ABA-compliant data collection, progress reporting, and IEP support tools
• Canadian provincial funding navigation
• Clinician collaboration portal (BrightConnect™)

4. Accounts and security

• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorised access at hello@getsetgrow.ca
• You may not share your account with others or use another person's account
• One account may have multiple child profiles (as permitted by your subscription plan)

5. Subscription plans and billing

5.1 Family Free plan

The Free plan provides limited access to GetSetGrow at no cost, indefinitely. We reserve the right to modify the features included in the Free plan with 30 days' notice.

5.2 GetSetGrow Family plan

Priced at $29.99 USD per month (or $279.99 USD per year). Billed at the start of each billing period. The annual plan represents a 22% saving over monthly billing.

5.3 GetSetGrow Clinic plan

Custom pricing based on clinic size, caseload, and required integrations. Clinic plan terms are set out in a separate Order Form agreed with GetSetGrow. Contact hello@getsetgrow.ca for a quote.

5.4 Billing and renewal

• Subscriptions renew automatically at the end of each billing period
• You may cancel at any time; cancellation takes effect at the end of the current paid period
• No refunds are issued for partial billing periods, except where required by law
• We may change pricing with 30 days' written notice; continued use after that date constitutes acceptance
• All prices are in USD unless otherwise stated. Canadian taxes (GST/HST) are applied where required

5.5 Free trial

We may offer free trial periods for paid plans from time to time. Trial terms will be clearly stated at the time of sign-up. No credit card is required for the Free plan.

6. Acceptable use

You agree not to:

• Use GetSetGrow for any unlawful purpose or in violation of these Terms
• Reverse engineer, decompile, or attempt to extract the source code of the GetSetGrow AI™ engine
• Scrape, harvest, or systematically collect data from the platform
• Use the platform to train competing AI models
• Share access credentials with unauthorised third parties
• Upload content that is false, harmful, or violates any law
• Attempt to circumvent security measures or access controls
• Use the platform in a way that could endanger the safety of a child

7. Intellectual property

GetSetGrow™, GetSetGrow AI™, BrightConnect™, the Progression Pyramid™, and all associated logos, designs, and content are the intellectual property of GetSetGrow Care Solutions Inc. All rights reserved.

We grant you a limited, non-exclusive, non-transferable licence to use the GetSetGrow platform for its intended purpose during the term of your subscription. This licence does not include the right to sublicense, resell, or distribute the platform or its content.

Your data: You retain ownership of the child profile data and clinical session data you input. You grant us a licence to use that data to provide and improve the service as described in our Privacy Policy.

8. Clinician responsibilities

If you are a clinician (BCBA, SLP, OT, or other healthcare professional) using GetSetGrow with clients:

• You remain responsible for all clinical decisions regarding your clients' care
• GetSetGrow AI™ outputs are suggestions, not clinical instructions
• You must obtain informed consent from clients and caregivers before using GetSetGrow in clinical practice
• You must comply with all applicable professional standards and ethics codes (BACB, ASHA, CASLPO, CAOT, etc.)
• You are responsible for ensuring data sharing with GetSetGrow complies with your professional obligations

9. Disclaimers and limitation of liability

We do not warrant that the service will be uninterrupted, error-free, or that clinical outcomes will be achieved. The GetSetGrow AI™ engine is a decision-support tool and its suggestions must be reviewed by qualified professionals.

To the maximum extent permitted by applicable law, our total liability for any claim arising out of or related to these Terms or the service shall not exceed the greater of (a) $100 CAD or (b) the amount you paid to us in the 12 months preceding the claim.

We are not liable for indirect, incidental, consequential, or punitive damages.

10. Indemnification

You agree to indemnify and hold harmless GetSetGrow Care Solutions Inc. and its officers, directors, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the service in violation of these Terms, your violation of any law, or your infringement of any third-party rights.

11. Termination

We may suspend or terminate your account if you violate these Terms, if your payment fails and is not rectified within 14 days, or if we are required to do so by law. We will give you reasonable notice where possible.

You may delete your account at any time in the app settings or by emailing hello@getsetgrow.ca.

Upon termination, your access ceases immediately. We will retain your data for the period described in our Privacy Policy and provide a data export upon request.

12. Governing law and disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.

Before initiating legal proceedings, we encourage you to contact us at hello@getsetgrow.ca to resolve disputes informally.

13. Changes to these Terms

We may update these Terms from time to time. We will notify you by email and in-app notice at least 30 days before material changes take effect. Continued use after that date constitutes acceptance of the revised Terms.

App accessibility features

Sensory adaptability

• Low Sensory Mode: pastel colour palette, no sound effects, slow animations — designed for children with sensory sensitivities
• Standard Mode: moderate colour, gentle sounds, standard animation speed
• High Engagement Mode: bright colours, audio feedback, celebratory animations — for children who benefit from more stimulation
• Reduce Motion: respects the operating system's "Reduce Motion" setting — all animations are disabled automatically
• No sudden flash transitions, no auto-playing audio, no alarming sounds

Motor and input accessibility

• Standard touch: all interactive elements have a minimum tap target of 48 × 48 pixels
• Switch scanning: single-switch and dual-switch scanning modes for children with limited motor range
• Eye-gaze: compatible with GazePointer and standard eye-gaze hardware via accessibility API hooks
• Keyboard navigation: full keyboard navigation on desktop (web) with visible focus indicators
• No time-limited interactions unless explicitly set as a therapy target (timers are off by default)
• Large, forgiving tap zones with no precision required

Visual accessibility

• High contrast mode toggle available in settings
• Colour-blind safe palette option — no information conveyed by colour alone
• All images and icons have descriptive alt text or are marked as decorative
• Text-to-speech for all on-screen text (via operating system accessibility settings)
• Symbol support mode: PCS/Widgit symbol overlays on activity items (available in Clinic plan)
• Minimum font size 16px on web; scalable text on iOS and Android

Hearing accessibility

• All audio content has a visual equivalent
• Closed captions on all video model content
• Haptic feedback as an alternative to audio cues (where device supports it)

Cognitive accessibility

• Never more than 3 items on screen at Levels 1–2 (lowest cognitive load)
• Consistent UI placement — buttons and navigation never move between screens
• Visual schedule always accessible in one tap from anywhere in the app
• "I need a break" button always visible during therapy sessions
• Clear, plain language throughout — no jargon in child-facing text
• Progress is communicated visually (bar charts, icons) not just numerically

Website accessibility

The getsetgrow.com and getsetgrow.ca websites are built to WCAG 2.1 AA standards:

• All heading levels used in correct hierarchical order (h1 → h2 → h3)
• All navigation links have descriptive text — no "click here" or "read more"
• All forms have associated labels and accessible error messages
• Skip-to-content link available via keyboard Tab from the top of every page

Known limitations

We are actively working to improve accessibility. Current known gaps include:

• French-language version of the website and app is in development
• Some complex chart components (ABA session graphs) have limited screen-reader descriptions — we are adding data table alternatives
• Eye-gaze calibration persistence across sessions is in development

What GetSetGrow is

GetSetGrow is a digital therapeutic support platform designed to supplement evidence-based therapy for children with neurodevelopmental differences. It provides:

• Structured practice activities aligned with established clinical frameworks
• An AI-assisted session personalisation engine (GetSetGrow AI™) that adapts activities based on performance data
• Progress tracking and ABA-style data collection tools
• Resources and tools to help families navigate Canadian provincial funding
• Collaboration features for families and licensed therapy professionals

What GetSetGrow is not

• Not a medical device: GetSetGrow has not been assessed or approved by Health Canada, the FDA, or any other regulatory body as a medical device
• Not a diagnostic tool: GetSetGrow does not and cannot diagnose ASD, ADHD, or any other condition. All diagnosis must be made by qualified healthcare professionals
• Not a substitute for assessment: GetSetGrow's entry assessment (the first 3 sessions) places children at an appropriate starting level for the app — it is not a clinical assessment equivalent to the ADOS-2, ADI-R, VB-MAPP, ABLLS-R, or similar validated instruments
• Not crisis support: GetSetGrow is not designed for behavioural emergencies. If a child is in distress or danger, contact emergency services or your child's healthcare provider immediately
• Not a replacement for IEP services: using GetSetGrow does not fulfil an obligation to provide services under an Individual Education Plan (IEP) or Individual Program Plan (IPP)

GetSetGrow AI™ — scope and limitations

The GetSetGrow AI™ engine is a rule-based and data-driven decision-support system. It:

• Adapts activity selection and prompt levels based on performance within the app
• Generates session summaries and progress reports for caregiver review
• Suggests activities from a clinically designed library

The AI engine does not:

• Make independent clinical decisions about a child's care plan
• Override or supersede the goals set by a child's therapy team
• Replace the clinical judgement of a licensed BCBA, SLP, OT, or physician
• Provide any guarantee of therapeutic outcome or developmental progress

All AI-generated suggestions, reports, and session summaries should be reviewed by a qualified professional as part of ongoing therapy. GetSetGrow AI™ outputs are starting points for clinical discussion, not clinical instructions.

Individual outcomes

Neurodevelopmental conditions are highly individual. GetSetGrow's activities and AI engine are designed to support evidence-based practice, but individual responses to therapy vary significantly. No specific outcome, milestone achievement, or rate of progress is guaranteed by using GetSetGrow.

Clinical decisions — including changes to a child's therapy programme, goals, or medication — should always be made in consultation with the child's healthcare and education team.

Emergency situations

GetSetGrow is not an emergency service. If you are concerned about a child's immediate safety, health, or wellbeing:

• In Canada: call 911 or go to your nearest emergency department

• Kids Help Phone: 1-800-668-6868
• Contact your child's paediatrician, GP, or specialist immediately

Professional use

Clinicians (BCBAs, SLPs, OTs, psychologists, and other registered healthcare professionals) who use GetSetGrow with clients are solely responsible for:

• Obtaining informed consent from clients and their guardians
• Determining the clinical appropriateness of GetSetGrow for each individual client
• Supervising client use of the app and reviewing AI-generated outputs
• Compliance with their professional regulatory body's standards and ethics codes
• Compliance with applicable privacy legislation (PIPEDA, provincial privacy laws, HIPAA where applicable)
